Privacy policy for the CLN Energy Smart Connect app

The CLN Energy Smart Connect app is a battery management system (BMS) app. It connects over Bluetooth to the battery management system in CLN equipment and shows the condition of the battery - state of charge, voltage, current, temperature and any faults - and alerts you when something needs attention. This policy sets out what it collects about you, why, who else sees it, and what you can ask us to do about it. It covers the app only.

This policy applies to the CLN Energy Smart Connect mobile application published by CLN Energy Limited — a battery management system app for CLN equipment, listed on Google Play under the name CLN Energy Smart Connect. Our website is covered separately by the website privacy policy. Both are written to meet the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.

Who we are

CLN Energy Limited, Plot No. 18, Phase-2, Sector 140, Noida, Uttar Pradesh 201305, India. For the purposes of the Digital Personal Data Protection Act, 2023 we are the Data Fiduciary for the personal data described here.

What the app collects

Categories of personal data collected by the CLN Energy Smart Connect app.
CategoryWhat it is
Account detailsThe name, mobile number and email address given when the account is created.
Battery and system dataReadings reported by the battery management system the app is paired with, such as state of charge, voltage, current, temperature, cycle count and fault codes, together with the unit's serial number.
Device informationThe model, operating system version and app version, used to support the app and diagnose faults.
Diagnostic logsRecords of errors and crashes, used to find and fix defects.

The permissions the app asks for, and why

Android asks you to grant these. You may refuse any of them, and withdraw them later in your phone's settings, although the app cannot reach a battery without Bluetooth.

Android permissions requested, and the reason for each.
PermissionWhy it is needed
BluetoothTo find and connect to the battery management system on your equipment.
LocationAndroid requires an app to hold location permission before it is allowed to scan for nearby Bluetooth devices. The app uses it for that purpose.
NotificationsTo alert you to a fault or an alarm raised by the battery.

Why we use it

  • To let you sign in and to keep your account.
  • To show you the condition of the battery the app is paired with, and to alert you to a fault.
  • To answer a support request and to honour a warranty claim.
  • To find and fix defects in the app and in our products.
  • To meet an obligation placed on us by law or by a regulator.

We do not sell personal data, and we do not use it to advertise to you.

Who else sees it

Data from the app is not shared with any third party for their own purposes. It may be disclosed where the law requires it, or where it is necessary to protect the safety of a person or the integrity of our equipment. If that changes, this page will say so before the change takes effect.

How long we keep it

Account data is kept while the account is open. When you ask us to delete the account, we remove it and the data held against it within 30 days. A few records outlive the account, each for a stated reason:

Records retained after an account is deleted.
What is keptWhy
Warranty and service recordsKept for the life of the warranty on the equipment, because the warranty is a commitment to the owner of the battery and not to an app account.
Records we are required to keepKept where a law or a regulator requires it, for no longer than that requires.
Safety and fault recordsFault and safety data relating to a battery may be kept without anything identifying you, so that a defect affecting other users can still be investigated.

Keeping it safe

We apply reasonable security practices as required under Indian law, including encrypting data in transit and restricting access to the staff who need it. No system can be guaranteed against every attack, and we would rather say so plainly than imply otherwise.

Your rights

Under the Digital Personal Data Protection Act, 2023 you may ask us to:

  • tell you what personal data of yours we hold and what we have done with it;
  • correct anything inaccurate, incomplete or out of date;
  • delete your account and the data held against it;
  • withdraw a consent you have given, which we will act on as readily as we acted on the consent;
  • nominate another person to exercise these rights if you are unable to; and
  • raise a grievance about how we have handled any of the above.

The quickest route for deletion is the account deletion page. For anything else, write to info@clnenergy.in and we will respond within the period the Act allows.

Deleting your account

You can ask for your account and its data to be deleted from inside the app, under your account settings, or on the CLN Energy Smart Connect app account deletion page, which needs no sign-in and does not require the app to be installed.

Children

The app is intended for the owners and operators of our equipment and is not directed at children. We do not knowingly collect the personal data of a child under 18 without the verifiable consent of a parent or guardian, as the Act requires. If we find that we have, we will delete it.

Changes to this policy

If this policy changes, the revised version will be published here with a new effective date. Where a change materially affects how your data is used, we will tell you in the app as well.
